General Terms and Conditions of Use of the Website

GENERAL PROVISIONS

The website “www.bataclan.fr” (hereinafter the “Website”) is the institutional and commercial Website of the Société d’Exploitation des Spectacles Bataclan (hereinafter “SESB ”).

These terms and conditions of use (hereinafter the “Terms and Conditions of Use”) are intended to notify the user (hereinafter the “User”) about the conditions under which said user may access the Site, and, if applicable, use the contents, of whatever kind, located therein or attached thereto (including, in particular, all information, databases, data, files, texts, images, photographs, audio and video animations, user interfaces, or any other work protected by copyright or by any other right of ownership) (hereinafter the “Data”).

The Website is currently published, on its own behalf, by the Société d’Exploitation des Spectacles Bataclan, a Simplified Joint-Stock Company, with share capital of 100 000 euros, listed in the Trade and Companies Register of Paris under the number 702 012 931, which holds production licences no. 1-1115183, no. 2-1115184 and no. 3-1115185, has the intra-Community VAT number FR 25 702 012 931, and whose head office is located at 50 boulevard Voltaire in Paris (75011).

ACCEPTANCE OF THE TERMS AND CONDITIONS OF USE

All persons using or viewing the Website implicitly undertake to comply with these Terms and Conditions of Use. The User must therefore read these Terms and Conditions of Use carefully.

AMENDMENTS TO THE WEBSITE AND THE TERMS AND CONDITIONS OF USE

The Website may change over time, and the SESB may have occasion to alter it and/or to amend these Terms and Conditions of Use, either in full or in part, at any time.
Said changes shall be made without prior notice, and shall be directly enforceable against Users without any other specific formal measures being required. All Users of the Website are therefore requested to refer, at the start of each session, to the latest version of the Terms and Conditions of Use, which will be permanently available on this page.

Any User who does not accept the changes made by the SESB in relation to the Website or the Terms and Conditions of Use is requested not to access the Website, and not to use the Website.

USE OF THE WEBSITE

The User may freely consult, for his or her own private, non-commercial use, the Data present on the Website, on condition that he or she respects the intellectual property rights, as defined in article 5 below.

The Data shall be regularly updated by the SESB, as and when it sees fit. Despite the best efforts taken to compile the Website and keep it updated, errors, inaccuracies or omissions may remain, and so too many problems connecting to the Website or interruptions to the connection. The SESB rejects all liability in this regard.

INTELLECTUAL PROPERTY RIGHTS

All the pages on the Website, including, specifically, the Data that the SESB allows Users to access from the Website, are liable to be protected by all and any regulations on copyright, and are the property of the SESB and/or their suppliers of content.
All reproduction and/or representation and/or distribution of said Content, in full or in part, is prohibited, unless expressly authorised, in writing, by SESB.

Rights to brands

The brands, whether in picture format or not, made visible on the Website are brands which may or may not be registered, belonging to (or owned by) SESB as regards the “BATACLAN” brand specifically, or to third parties (hereinafter jointly referred to as the “Brands”).

The mentioning of Brands on the Website does not, in any way, whether implicitly or explicitly, constitute the granting of a right of use, a licence or any authorisation whatsoever in relation to said Brands; except in the case of specific, prior consent, in writing, from SESB and any third parties that may be concerned.

Any use of the Brands referred to on the Website which is not authorised through specific, prior consent, in writing, from SESB, and any third party that may be concerned, is strictly prohibited. SESB and/or the third parties concerned may undertake any legal action, including in criminal law proceedings, in order to ensure that their rights to the Brands are complied with.

INFORMATION AND PERSONAL DATA

In order to implement the services offered on the Website, the SESB may have occasion to collect and process the personal data of any person using the said Website. The terms and conditions of said collection and processing, performed by SESB, and the rights of the user in this regard, are defined in the confidentiality agreement on the Website: https://www.bataclan.fr/fr/charte-confidentialite.

LIABILITY – LINKS TO THIRD PARTIES

Exclusion of liability

Despite all the care taken to create the Website and keep it regularly updated, the Website may contain inaccuracies and/or typographical errors in the information and/or Data displayed. The liability of SESB cannot, under any circumstances, be incurred in this regard.

In order to improve the Website, or during maintenance operations (whether scheduled or due to emergencies), SESB may have occasion, from time to time, to temporarily interrupt the functioning of the Website, without notice. SESB cannot be held liable for any damage caused by said maintenance operations.

Furthermore, the User warrants to SESB that he/she will use the Website in strict compliance with these Terms and Conditions of Use. To this end, the User holds SESB harmless against any recourse, including legal fees and the cost of litigation, court orders, damages, losses, and miscellaneous costs and expenses incurred by SESB and resulting from any claim, request, assertion, remedy, action or court ruling, insofar as they had as their cause, basis or origin, whether directly or indirectly, a breach of these Terms and Conditions of Use. SESB rejects all liability in the event of a wrongful or unlawful use of all or part of the contents of the Website or of the Data.

Links to other Websites

The Website may contain images and links to other Websites or other Internet resources managed by third parties (hereinafter “External Sites”). SESB has no control over the External Sites and accepts no liability whatsoever, in relation specifically to their content and to the links displayed on the External Sites. SESB is not responsible for the distribution on the Internet of any data received from an External Site, and this is the case even if the External Sites are not working properly or at all, or damage the User’s information systems.

Said links are only offered to the User by SESB for the latter’s convenience, and the insertion of links does not mean that SESB approves of the content of said External Sites, nor does it imply that a legal relationship of any kind whatsoever exists between SESB and the operators of the External Sites. Users accessing, via a hyper-link, any other site linked to the Website, do so solely at their own risk. It is the User’s responsibility to comply with all the regulations that apply to External Sites, and with their respective general terms and conditions of use.

The mentioning of links or brands, names, services, domain names and titles of other companies does not in any way imply that any association whatsoever exists between SESB and the companies, products or services, brands, names or titles in question.

Hyper-text links

The creation of hyper-text links to the Website is subject to SESB’s prior consent. In the event that a hyper-text link to the Website is created, for which the prior consent of SESB was not obtained, SESB reserves the right to demand, at any time, that the said hyper-text link, leading to the Website, be withdrawn.

MISCELLANEOUS PROVISIONS

The Website and these Terms and Conditions of Use are subject to the provisions of French law.

All disputes relating to the interpretation or implementation hereof, and more generally all disputes linked to, or related to the accessing or use of the Website and/or any element accessible on the Website, shall be subject to the exclusive jurisdiction of the courts of Paris.
